ARTICLE 1 – Definitions

 

For the purposes of this article, please note that:

refers to requests for extra Services such as, but not only: Air companies, hotels, providers of activities at the Destinations in accordance with the Services chosen by the Clients, etc.

ARTICLE 2 - Applicability

 

The TC apply without restrictions to all of the sales of Services to Clients

 

The TC can be consulted on the Website at any time and the TC on the Website take precedence over any other versions of the TC

 

The TC represent the full rights and obligations of the parties in respect of the Services provided. If at some point Crazy Voyages fails to apply any of the conditions on the TC this cannot be interpreted to mean that Crazy Voyages will renounce applying any of the said conditions at some future point in time.

 

The TC can be modified at any date and without prior warning, however, the modified TC will only apply to reservations of Services made after that date.  It is obligatory for the Clients to read and accept the TC at the time of booking.

 

Any terms and conditions produced by the client cannot be included in or prevail over the TC. The Client renounces to have recourse to such a document cannot be used against Crazy Voyages.

 

The Specific Conditions of the Suppliers apply to the sale of Services in the same way as the TC (from here on referred to as the Specific Conditions). The Specific Conditions become effective when a booking in made with the Supplier.

 

 

ARTICLE 3 – Client Eligibility and Acceptance

 

3.1 – Eligibility 

The client(s) must be over the age of 18, be sound of mine, and under the protection of the court for the financial reasons.

 

 

3.2 – Acceptance of the TC

Services will be sold only to Clients who have read the TC and accepted them by ticking the box or clinking on the hyperlink provided.

Consequently, when the client buys Services on the Website the Client irrevocably agrees to to accept the TC.

 


ARTICLE 4 – Description of Services

 

The objective of Crazy Voyages is to enable a given group of Clients, of between 4 and 20 people, to purchase Services on the Website in order to have a holiday in France or in a foreign country amongst friends, for example for a stag night, or a hen night for one of the group’s members (from here on referred to as the Holiday). For a given Holiday there will be within the group of Clients the person or persons who take the initiative to organise the holiday, and who will be in contact with Crazy Voyages, from here on referred to as the Organiser(s), and the persons who participate from here on referred to as the Participant(s)

 

Crazy Voyages offers on the Website, for a fixed price per Client, packages of Services. These include, depending on the choice of destination amongst those on offer (from here on referred to as the Destination) and unless otherwise stated on the website:

 

-          Air transport to and from the Destination in the conditions described in article 4.1 below

-          Accommodation at the Destination in the conditions described in article 4.2 below

-          One or more activities in the conditions described in article 4.3 below

 

In addition to the basic package described below the Client has the possibility to choose optional activities in the conditions described in article 4.3 below (from here on referred to as Options.

 

4.1 - Air Transport

 

The packages offered by Crazy Voyages generally include return air transport provided by an airline (low cost or regular airline) to and from the Destination departing from the town or city selected when making the reservation. It is also possible to book a package without air transport for certain Destinations as stipulated on the Website.

 

The conditions of provision of air transport are governed by the Specific Conditions of the airline concerned.

 

It is the Clients’ responsibility to respect the airlines’ rules and regulations especially with regards to the check in times (normally two hours before take-off) and if necessary confirmation your flight times 48 to 72 hours prior to take-off, if and as stipulated in the airlines’ Specific Conditions.

 

The Clients must be in possession of a valid identity card or passport, and if the Destination country requires it, the documents must be valid for six months after the expected return date.

 

If these conditions are not complied with, and the Clients cannot depart on their Holiday on the date indicated in the booking, no refund can be given.

 

It is solely the Client’s responsibility to ensure that he is in possession of the necessary documents for travelling whether this is an identity card, passport, or visa. Non EU Clients should pay particular attention to this.

 

In case of loss or theft of a ticket the Client must make a declaration to the police and to the airline company and obtain a replacement from the Supplier. The Specific Conditions of the Supplier in respect of reimbursement or replacement of the missing ticket will apply. Crazy Voyages will make every effort in assisting the Client in this matter.

 

It is brought to your attention that the responsibility of the airlines is often limited by national or by international law as underlined in their Specific Conditions. A copy of the airline’s conditions is given to the client with their tickets.

 

Clients are reminded that an e ticket is not a paper ticket and that the Clients must go to the airline’s check in desk with their valid identity documents (passport, identity card, visa as applicable) to obtain the boarding cards. It is important to respect the advised check in time.

 

4.2 - Accommodation

 

The packages offered by Crazy Voyages on the Website include one(1) or two(2) nights’ accommodation at the Destination.

 

The Organiser chooses the type of accommodation by ticking the appropriate box during the booking process.

 

Concerning the hotels:

-The indication of the level of comfort (*) which figures in the accommodation description on the Website corresponds to the local standards of the Destination country and may differ from French standards. Occasionally in case of Force Majeure or through no fault of Crazy Voyages the chosen hotel may have to be replaced by a different hotel but this will of the same standard and offer the same options.

-It is normal practice for the rooms to be available from two pm (14.00h) and they must be vacated by mid-day (12.00h) regardless of arrival and departure times by the chosen method of transport.

 

Concerning the apartments:

-For most Destinations two nights’ accommodation must be booked for an apartment

-The capacity of an apartment is defined by the number of beds and not the number of rooms. Thus in some apartments some of the beds may be in the living area or there may be more than one bed in each bedroom. 

 

4.3 – Activities and Options

 

In addition to the Services mentioned in 4.1 and 4.2 above the basic package can include one or more activities in accordance with the description on the Website for each Destination.

 

The options can be chosen by the Organiser by ticking the appropriate boxes during the booking process using the booking form referred to in Article 7 below.

 

In the case of options included in the package and the eventual options added on by the Organiser the Supplier’s Specific Conditions prevail.

 

In the eventuality of Options being cancelled notably due to weather conditions or the number of Participants being insufficient to carry out the activity, Crazy Voyages will do its best to provide a replacement activity without any additional cost to the Client.

 

However the cancellation of an activity or Option due to Force Major will not entitle the Client to an indemnity.

 

The photographs and illustrations provided in the descriptions on the Website are for illustration purposes only. Crazy Voyages reserves the right to use photographs which may not be of the actual venue. Their purpose is to give customers an overview of available services.

 

ARTICLE 5 – Special Services

 

Whenever possible Crazy Voyages can offer Special Services, upon request from the Clients, such as a different departure point for a given Holiday, or a duration of more than two(2) nights’ accommodation for the Holiday, or for a group exceeding 20 people, etc.

 

It is possible for the Client to purchase only the accommodation, and the activities (or Options) and to make his own arrangements for the air transport.

 

If the Client has any specific requests for Special Services he must advise Crazy Voyages via the booking form referred to in Article 7 below.

 

Crazy Voyages will do its best to comply and will provide the Client with a specific estimate in respect of the Special Services requested by the Client.

 

 

ARTICLE 6 – Pricing

 

The descriptions of the Holidays on offer on the Website detail, for each Destination, the Services included in the price. There is an extra charge for Options which is calculated based on the number of Participants as shown on the Website.

 

The Client will be given a detailed estimate showing the total cost of the Holiday including all Services and eventually any Options, and the breakdown of the cost item by item as explained in article 7 below.

 

In consequence, and taking into account the number and the variations in and of the Services and Options which can be combined by Crazy Voyages to adapt to the Clients’ wishes, the resulting estimate may differ from the prices quoted on the Website.

 

Prices are in Euros and include all taxes unless specifically mentioned on the Website or in the estimate.

 

The following are not usually included in the price; delivery of travel documents, airport services, excess baggage charges, airport transfers, visas, vaccinations, and all personal expenses (tips, dry cleaning, laundry, room service, drinks, taxis, telephone, public transport) and anything else not mentioned in the estimate.

 

The prices can be modified at any time and without warning. This will not affect any bookings that have been confirmed except if the change in price occurs more than 30 days before departure date and occurs because of fuel costs, taxes and legal costs or the exchange rate.

 

In the event of a price increase for one of the reasons mentioned in the previous paragraph the Client will only pay the proportion of the increase applicable to their Holiday but this does not affect the Clients right to cancel their contract under article R211-9 of the Code du Tourisme.

 

ARTICLE 7 – Booking

 

To make a booking the Organiser clicks on “quote” or “booking” on the Website and fills in his details on the form. The Organiser states, in the fields provided for this purpose, contact information, email address, desired destination, the City of Departure, the estimated number of participates, the dates of departure and return, the type of accommodation required, and the Options. 

 

It is the Organiser’s responsibility to ensure that the Participants’ details provided correspond to the details that figure on the passport or identity card of the Participants. The Specific Conditions of some of our Suppliers make provision for a surcharge to be applied if incorrect information has to be corrected at a later date. Crazy Voyages cannot be held responsible for mistakes of this type.

 

When the Organiser submits the booking form he will receive an e mail from Crazy Voyages with a promise to provide an estimate by a given date.

 

On the basis of the information given by the Organiser a tailor made estimate for the Holiday is prepared by Crazy Voyages and sent to the Organiser by e mail. The Organiser can share this information with the other Participants by giving them the URL for the estimate. The Participants will then have direct access to all the details contained in the estimate such as the flight times (if applicable) and the following elements:

 

-          The details of the Services offered and the total price per Client based on the number of Participants indicated by the Organiser on the booking form

 

-          If the Activity requires a specific number of participants, we have to notify the customer in case of cancellation, the Activity / Holiday will have a date limit for cancellation of at least twenty one (21) days before the departure date (Article R. 211-4 7 of the Code du Tourisme).

 

Once the estimate has been issued, the total price per Client remains valid as long as the price of the air transport remains unchanged by the airline company concerned.

 

The Organiser should confirm the exact number of Participants as soon as possible. The full names and e mail addresses of all the Participants are required when confirming the booking, if the estimate is accepted by the Organiser.

 

It is requested to the Organiser to confirm to Crazy Voyages, the exact number of participants, as soon as possible. The Organiser must also provide the information mentioned above for Participants who were not initially mentioned.

 

The booking is valid once payment is made as detailed in Article 8.

 

ARTICLE 8 – Payment and Booking Confirmation

 

Once the Clients have confirmed the booking they will be given access to a secure payment platform where they can pay by Visa or MasterCard debit or credit. It is possible for each Client to choose to:

 

-          Pay just their share

-          Pay for other Clients

-          Pay the total amount due

 

Before paying Clients must confirm that they have read and accepted the TC by ticking the required box. Consequently this means that in proceeding with the payment the Client has accepted the TC.

 

If a Client pays the share of an/other Participant/s as well as his own he promises to pass on the information contained in the TC to the said Participant/s.

 

All payments made by credit card are debited immediately.

 

If, when a Participant proceeds to payment the time lapse has entailed a change in the price of the flights from the original price quoted on the estimate, the client will be informed of the new price of the flights before the payment is processed.

 

If, when a Participant proceeds to payment the time lapse means that the flights quoted for in the estimate are no longer available Crazy Voyages will assist the Client and try to help him find a solution with the Supplier.

 

Bookings can only be confirmed when all of the Participants have paid in full.

 

The booking confirmation sent out by Crazy Voyages itemises the main elements of the booking such as details of the Services, the price paid and, if applicable specific conditions of payment. The confirmation is sent via email to the Client as soon as possible after full payment has been received.

 

Failure by the Client to make full or part payment will result in the Services being suspended and any costs resulting from this must be paid by the Client without this affecting any additional liability action that could be instigated against them.

 

Consequently if the number of Participants initially included in the booking is not attained the Clients who have booked and paid for the Holiday could be required to pay a supplement in order maintain all the Services and Options selected.

 

It could transpire that a large number of Participants initially included in the booking decide not to confirm their reservation whilst the Organiser and a few of the Participants have already paid. Consequently the Organiser might decide to cancel within 24 hours of having made the booking. In this case, Crazy Voyages reserves the right to retain the sum of 350 Euros to cover costs.

 

ARTICLE 9 – Cancellation or Modification at Request of the Client

 

Any cancellation or request for modification must be made by email or by registered letter to Crazy Voyages at the address which is set out at the beginning of this document

 

Unless specifically mentioned in the booking, all modifications (change of dates, times, Destination, Accommodation) or all cancellations requested by the Clients more than three weeks before departure date excepting Force Majeure and unless the Supplier agrees more favourable conditions will give rise to a reimbursement of 50% of the cost of the Services, excluding the air transport, the remainder being conserved by Crazy Voyages to cover their losses. If the cancellation or modification occurs less than three weeks before departure, Crazy Voyages will not reimburse the client and will conserve 100% of the cost of the Services, excluding the air transport, to cover their losses.

 

Also, when the payment has been made in two parts, with a deposit, there will be no compensation given to the client, even if the cancellation request occurs more than three weeks before the departure date.

 

Force Majeure means any event which we could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

 

Requests for reimbursement of the air transport will be treated separately in accordance with the Suppliers Specific Conditions. 

 

Furthermore, in the case of a ticket reissue or a new booking made after a cancellation or a modification made by the Client, it is brought to your attention that the cost of the new ticket or the new booking may be superior to the initial ticket and/or booking, and in the case of some Suppliers could entail additional costs which must be borne by the Client (for example, but not only, booking charges, booking amendment charges etc) in application of the Specific Conditions of the Airline concerned.

 

ARTICLE 10 – Itinerary and Travel Documents

 

The itinerary, e-tickets and the travel documents will be sent to the Clients at least five days before the departure date, providing that the full costs have been paid, as stipulated in Article 8 of the TC.

 

The itinerary will give full details of the Services (departures and arrival times, accommodation, address etc) and all the necessary and useful information for your Holiday. There will also be a guide to all the night clubs, bars and restaurants recommended by Crazy Voyages for the chosen Destination. 

 

The telephone number given on your travel documents is the number to call if you need urgent assistance from Crazy Voyages at your Destination.

 

ARTICLE 11 – Complaints

 

Any eventual queries, problems, or complaints should be notified to Crazy Voyages who will be responsible for passing them on to the Suppliers, no more than thirty (30) days after the end of the Holiday and this should be sent by registered letter addressed to Crazy Voyages at the address given at the beginning of this document, or by email address given at the beginning of this document.

 

Complaints will be investigated only if the problem was brought to attention of the Supplier or Crazy Voyages during the Holiday, enabling an immediate solution to be found thus limiting any prejudice the client may undergo.

 

No liability will be accepted concerning loss, damage or theft of luggage, clothes or personal possessions belonging to the Client(s) unless negligence, on the part of the Supplier or Crazy Voyages, can be proven.

 

ARTICLE 12 – No Right to Withdraw

 

It is proposed to the Customer that, pursuant to Article L. 121-20-4 of the Consumer Code, the Services offered on the Website are not subject to the application of the right of withdrawal provided for in Articles L. 121-20 and following the code of distance selling consumer.

 

ARTICLE 13 – Liability

 

Crazy Voyages will not accept any liability for the problems arising concerning the provision of the Services due to; the acts or omissions of the Client, the acts or omissions of a third party, not connected with the provision of Services, which were unforeseeable or unavoidable, an act of Force Majeure normally recognised by French Law. 

An act of Force Majeure automatically exonerates the party concerned in the supply of Services when the Force Majeure occurs from all responsibility.

 

ARTICLE 14 – Insurance

 

Insurance cover is not included for the Services offered by Crazy Voyages. Clients are advised to take out an insurance policy to cover any costs that might arise in certain cases due to cancellation such as medical and transport costs in case of illness or accident. It is solely the responsibility of the Client to ensure that he makes provision for insurance cover with the company of his choice.

Crazy Voyages is insured for Professional Liability with the insurance company mentioned in the preface of these TC which covers any financial loss the insured may suffer in respect of injuries, or material damage, consecutive or not, caused to Clients, Suppliers or a third party, in case of errors, omissions, or negligence in the course of carrying out the profession of a travel agent to the amount of 750,000.00 Euros per year and by claim for injuries, or material damage, consecutive or not. The excess for all claims excepting injuries amounts to 1,500.00 Euros.

 

ARTICLE 15 - Data Protection and Privacy

 

The law 78-17 of 6 January 1978 states that the personal information and details provided by the Client is needed in order to proceed with the booking on the Website and is destined solely for internal use by Crazy Voyages, and will only be passed on to third parties if this is required for the purpose of completing your transaction with Crazy Voyages.

 

Finally, in accordance with the French law the Data Protection Act gives you the right to request a copy of the personal information CRAZY VOYAGES SARL holds about you and to have it deleted or to have any inaccuracies corrected. (Article 34 of the Data Protection Act of 6 January 1978. Please address your request to contact@crazy-voyages.com. 

 

The details and information obtained by Crazy Voyages in the course of its activity as a travel agent are the proof that transactions have taken place and are undisputed evidence that an agreement has been entered into. In the event of a legal dispute, electronic data has the same legal consequences as a printed, signed document.

 

This Website and all the elements that for the content of the Website, whether they be visual or audio, are protected by copyright. The Website and all that it contains, is the exclusive property of Crazy Voyages and/or its Suppliers or, as the case may be, the respective owners with whom they have an agreement.

 

ARTICLE 16 – Copyright

 

The Website and all the elements that form the content of the Website, whether they are visual or audio, including the underlying technology, are protected by copyright trademarks, designs or patents. The Website and all that it contains (including, but not limited to; text, software, photographs, logos, date) is the exclusive property of Crazy Voyages and/or its Suppliers, or as the case may be the respective owners with whom they have the agreement.  Any representation, reproduction (other than for private use), exploitation, distribution or adaption of the Website or its parts is prohibited. 

The use of all software downloaded via the Website which gives access to certain Services or functions, is governed by the terms of its license. The Client must accept the terms of the license before downloading, installing, copying or using the aforementioned software.

For all software which does not have a license, the Client is given limited rights for a private personal and excludes all other use. By installing or using the software, the Client accepts these conditions.

Users of the Website who have their own personal Website and who wish to add a link to the homepage, for their own personal use, must obtain authorisation from Crazy Voyages before doing so. However, this authorisation does not imply any affiliation agreement. In all cases, all links, even if agreed to, must be removed at the request of Crazy Voyages.

To resume, all links to the Website must be previously authorised by Crazy Voyages and immediately removed at their request.

 

ARTICLE 17 - Transfer

 

In accordance with article R. 211-7 of the Code du tourisme, a Client can transfer his contract to a transferee providing he has the same eligibility to effect the Holiday in the same conditions as the Client, if the Holiday has not commenced, and taking into account the conditions imposed in article 9 above.

 

The Client must inform Crazy Voyages of his decision to do so at least seven days before the departure date, by registered post or email.

 

ARTICLE 18 – Cancellation

 

The client can cancel the contract and receive full reimbursement without penalty of the amount paid, if Crazy Voyages does not comply with the obligation cited in paragraph 13 of R. 211-4 of the Code du Tourisme.

 

ARTICLE 19 – Applicable Law and Jurisdiction

 

The TC are subject to French law. In the event of any dispute which cannot be resolved amicably, French courts will have sold jurisdiction unless information to the contrary is given in the TC.

 

ARTICLE 20 – Reproductions of Articles R.211-3 to R.211-11 of the Code du Tourisme

Article R. 211-3 :

 

Sous réserve des exclusions prévues aux troisième et quatrième alinéas de l'article L. 211-7, toute offre et toute vente de prestations de voyages ou de séjours donnent lieu à la remise de documents appropriés qui répondent aux règles définies par la présente section.

En cas de vente de titres de transport aérien ou de titres de transport sur ligne régulière non accompagnée de prestations liées à ces transports, le vendeur délivre à l'acheteur un ou plusieurs billets de passage pour la totalité du voyage, émis par le transporteur ou sous sa responsabilité. Dans le cas de transport à la demande, le nom et l'adresse du transporteur, pour le compte duquel les billets sont émis, doivent être mentionnés.

La facturation séparée des divers éléments d'un même forfait touristique ne soustrait pas le vendeur aux obligations qui lui sont faites par les dispositions réglementaires de la présente section.

 

Article R. 211-3-1 :

 

L'échange d'informations précontractuelles ou la mise à disposition des conditions contractuelles est effectué par écrit. Ils peuvent se faire par voie électronique dans les conditions de validité et d'exercice prévues aux articles 1369-1 à 1369-11 du code civil. Sont mentionnés le nom ou la raison sociale et l'adresse du vendeur ainsi que l'indication de son immatriculation au registre prévu au a de l'article L. 141-3 ou, le cas échéant, le nom, l'adresse et l'indication de l'immatriculation de la fédération ou de l'union mentionnées au deuxième alinéa de l'article R. 211-2.

 

Article R. 211-4 :

 

Préalablement à la conclusion du contrat, le vendeur doit communiquer au consommateur les informations sur les prix, les dates et les autres éléments constitutifs des prestations fournies à l'occasion du voyage ou du séjour tels que :

1° La destination, les moyens, les caractéristiques et les catégories de transports utilisés ;

2° Le mode d'hébergement, sa situation, son niveau de confort et ses principales caractéristiques, son homologation et son classement touristique correspondant à la réglementation ou aux usages du pays d'accueil ;

3° Les prestations de restauration proposées ;

4° La description de l'itinéraire lorsqu'il s'agit d'un circuit ;

5° Les formalités administratives et sanitaires à accomplir par les nationaux ou par les ressortissants d'un autre Etat membre de l'Union européenne ou d'un Etat partie à l'accord sur l'Espace économique européen en cas, notamment, de franchissement des frontières ainsi que leurs délais d'accomplissement ;

6° Les visites, excursions et les autres services inclus dans le forfait ou éventuellement disponibles moyennant un supplément de prix ;

7° La taille minimale ou maximale du groupe permettant la réalisation du voyage ou du séjour ainsi que, si la réalisation du voyage ou du séjour est subordonnée à un nombre minimal de participants, la date limite d'information du consommateur en cas d'annulation du voyage ou du séjour ; cette date ne peut être fixée à moins de vingt et un jours avant le départ ;

8° Le montant ou le pourcentage du prix à verser à titre d'acompte à la conclusion du contrat ainsi que le calendrier de paiement du solde ;

9° Les modalités de révision des prix telles que prévues par le contrat en application de l'article R. 211-8 ;

10° Les conditions d'annulation de nature contractuelle ;

11° Les conditions d'annulation définies aux articles R. 211-9, R. 211-10 et R. 211-11 ;

12° L'information concernant la souscription facultative d'un contrat d'assurance couvrant les conséquences de certains cas d'annulation ou d'un contrat d'assistance couvrant certains risques particuliers, notamment les frais de rapatriement en cas d'accident ou de maladie ;

13° Lorsque le contrat comporte des prestations de transport aérien, l'information, pour chaque tronçon de vol, prévue aux articles R. 211-15 à R. 211-18.

 

 

Article R. 211-5 :

 

L'information préalable faite au consommateur engage le vendeur, à moins que dans celle-ci le vendeur ne se soit réservé expressément le droit d'en modifier certains éléments. Le vendeur doit, dans ce cas, indiquer clairement dans quelle mesure cette modification peut intervenir et sur quel éléments.

En tout état de cause, les modifications apportées à l'information préalable doivent être communiquées au consommateur avant la conclusion du contrat.

 

Article R. 211-6 :

 

Le contrat conclu entre le vendeur et l'acheteur doit être écrit, établi en double exemplaire dont l'un est remis à l'acheteur, et signé par les deux parties. Lorsque le contrat est conclu par voie électronique, il est fait application des articles 1369-1 à 1369-11 du code civil. Le contrat doit comporter les clauses suivantes :

1° Le nom et l'adresse du vendeur, de son garant et de son assureur ainsi que le nom et l'adresse de l'organisateur ;

2° La destination ou les destinations du voyage et, en cas de séjour fractionné, les différentes périodes et leurs dates ;

3° Les moyens, les caractéristiques et les catégories des transports utilisés, les dates et lieux de départ et de retour ;

4° Le mode d'hébergement, sa situation, son niveau de confort et ses principales caractéristiques et son classement touristique en vertu des réglementations ou des usages du pays d'accueil ;

5° Les prestations de restauration proposées ;

6° L'itinéraire lorsqu'il s'agit d'un circuit ;

7° Les visites, les excursions ou autres services inclus dans le prix total du voyage ou du séjour ;

8° Le prix total des prestations facturées ainsi que l'indication de toute révision éventuelle de cette facturation en vertu des dispositions de l'article R. 211-8 ;

9° L'indication, s'il y a lieu, des redevances ou taxes afférentes à certains services telles que taxes d'atterrissage, de débarquement ou d'embarquement dans les ports et aéroports, taxes de séjour lorsqu'elles ne sont pas incluses dans le prix de la ou des prestations fournies ;

10° Le calendrier et les modalités de paiement du prix ; le dernier versement effectué par l'acheteur ne peut être inférieur à 30 % du prix du voyage ou du séjour et doit être effectué lors de la remise des documents permettant de réaliser le voyage ou le séjour ;

11° Les conditions particulières demandées par l'acheteur et acceptées par le vendeur ;

12° Les modalités selon lesquelles l'acheteur peut saisir le vendeur d'une réclamation pour inexécution ou mauvaise exécution du contrat, réclamation qui doit être adressée dans les meilleurs délais, par tout moyen permettant d'en obtenir un accusé de réception au vendeur, et, le cas échéant, signalée par écrit, à l'organisateur du voyage et au prestataire de services concernés ;

13° La date limite d'information de l'acheteur en cas d'annulation du voyage ou du séjour par le vendeur dans le cas où la réalisation du voyage ou du séjour est liée à un nombre minimal de participants, conformément aux dispositions du 7° de l'article R. 211-4 ;

14° Les conditions d'annulation de nature contractuelle ;

15° Les conditions d'annulation prévues aux articles R. 211-9, R. 211-10 et R. 211-11 ;

16° Les précisions concernant les risques couverts et le montant des garanties au titre du contrat d'assurance couvrant les conséquences de la responsabilité civile professionnelle du vendeur ;

17° Les indications concernant le contrat d'assurance couvrant les conséquences de certains cas d'annulation souscrit par l'acheteur (numéro de police et nom de l'assureur) ainsi que celles concernant le contrat d'assistance couvrant certains risques particuliers, notamment les frais de rapatriement en cas d'accident ou de maladie ; dans ce cas, le vendeur doit remettre à l'acheteur un document précisant au minimum les risques couverts et les risques exclus ;

18° La date limite d'information du vendeur en cas de cession du contrat par l'acheteur ;

19° L'engagement de fournir à l'acheteur, au moins dix jours avant la date prévue pour son départ, les informations suivantes :

a) Le nom, l'adresse et le numéro de téléphone de la représentation locale du vendeur ou, à défaut, les noms, adresses et numéros de téléphone des organismes locaux susceptibles d'aider le consommateur en cas de difficulté ou, à défaut, le numéro d'appel permettant d'établir de toute urgence un contact avec le vendeur ;

b) Pour les voyages et séjours de mineurs à l'étranger, un numéro de téléphone et une adresse permettant d'établir un contact direct avec l'enfant ou le responsable sur place de son séjour ;

20° La clause de résiliation et de remboursement sans pénalités des sommes versées par l'acheteur en cas de non-respect de l'obligation d'information prévue au 13° de l'article R. 211-4 ;

21° L'engagement de fournir à l'acheteur, en temps voulu avant le début du voyage ou du séjour, les heures de départ et d'arrivée.

 

Article R. 211-7 :

 

L'acheteur peut céder son contrat à un cessionnaire qui remplit les mêmes conditions que lui pour effectuer le voyage ou le séjour, tant que ce contrat n'a produit aucun effet.

Sauf stipulation plus favorable au cédant, celui-ci est tenu d'informer le vendeur de sa décision par tout moyen permettant d'en obtenir un accusé de réception au plus tard sept jours avant le début du voyage. Lorsqu'il s'agit d'une croisière, ce délai est porté à quinze jours. Cette cession n'est soumise, en aucun cas, à une autorisation préalable du vendeur.

 

Article R. 211-8 :

 

Lorsque le contrat comporte une possibilité expresse de révision du prix, dans les limites prévues à l'article L. 211-12, il doit mentionner les modalités précises de calcul, tant à la hausse qu'à la baisse, des variations des prix, et notamment le montant des frais de transport et taxes y afférentes, la ou les devises qui peuvent avoir une incidence sur le prix du voyage ou du séjour, la part du prix à laquelle s'applique la variation, le cours de la ou des devises retenu comme référence lors de l'établissement du prix figurant au contrat.

 

Article R. 211-9 :

 

Lorsque, avant le départ de l'acheteur, le vendeur se trouve contraint d'apporter une modification à l'un des éléments essentiels du contrat telle qu'une hausse significative du prix et lorsqu'il méconnaît l'obligation d'information mentionnée au 13° de l'article R. 211-4, l'acheteur peut, sans préjuger des recours en réparation pour dommages éventuellement subis, et après en avoir été informé par le vendeur par tout moyen permettant d'en obtenir un accusé de réception :

-soit résilier son contrat et obtenir sans pénalité le remboursement immédiat des sommes versées ;

-soit accepter la modification ou le voyage de substitution proposé par le vendeur ; un avenant au contrat précisant les modifications apportées est alors signé par les parties ; toute diminution de prix vient en déduction des sommes restant éventuellement dues par l'acheteur et, si le paiement déjà effectué par ce dernier excède le prix de la prestation modifiée, le trop-perçu doit lui être restitué avant la date de son départ.

 

Article R. 211-10 :

 

Dans le cas prévu à l'article L. 211-14, lorsque, avant le départ de l'acheteur, le vendeur annule le voyage ou le séjour, il doit informer l'acheteur par tout moyen permettant d'en obtenir un accusé de réception ; l'acheteur, sans préjuger des recours en réparation des dommages éventuellement subis, obtient auprès du vendeur le remboursement immédiat et sans pénalité des sommes versées ; l'acheteur reçoit, dans ce cas, une indemnité au moins  égale à la pénalité qu'il aurait supportée si l'annulation était intervenue de son fait à cette date.

Les dispositions du présent article ne font en aucun cas obstacle à la conclusion d'un accord amiable ayant pour objet l'acceptation, par l'acheteur, d'un voyage ou séjour de substitution proposé par le vendeur.
